Product: TowMech Mobile App + Web Services (“Platform”)
By accessing, registering, or using TowMech, you agree to these Terms & Conditions. If you do not agree, do not use the Platform.
1. About TowMech
TowMech is a digital platform that connects:
- Customers requesting towing or mechanical services, and
- Service Providers (Tow Truck operators and Mechanics) who offer such services.
TowMech provides technology and coordination tools only and does not guarantee outcomes, pricing, provider availability, or service quality.
2. Eligibility & Account Responsibility
You confirm that:
- You are at least 18 years old, or legally allowed to use the Platform.
- You will provide accurate information during registration and keep it updated.
- You are responsible for all activities performed under your account.
TowMech may require verification of identity, documents, location, or contact details at any time.
3. TowMech’s Right to Accept, Reject, Suspend or Terminate
TowMech reserves the full right, at its sole discretion, to:
- Approve or reject any user or provider registration
- Suspend, restrict, or terminate access to any account
- Remove any content, listings, messages, or profile information
- Block or blacklist any user, device, phone number, or payment method
This may happen without notice, for any reason including but not limited to:
- Suspected fraud or dishonesty
- Safety concerns
- Abuse, threats, harassment, or violence
- Misuse of the Platform
- Fake documents or impersonation
- Payment disputes, chargebacks, or suspicious activity
- Violation of these Terms
- Any conduct that may harm TowMech, users, providers, or the public
TowMech’s decision is final and not subject to appeal.
4. User Vigilance & Safety Responsibility
TowMech strongly requires that all users remain vigilant, careful, and judgmental when interacting with others on the Platform.
Customers must:
- Verify provider identity and vehicle before accepting service
- Avoid unsafe environments and keep personal valuables secured
- Use judgment before allowing anyone into personal space or vehicle
- Avoid cash handling in unsafe situations
Providers must:
- Confirm job details before proceeding
- Ensure personal safety before arriving at any location
- Avoid dangerous areas, suspicious requests, or unlawful instructions
TowMech is not responsible for any harm, damage, theft, or conflict arising from user-to-user interactions.
5. No Guarantee of Service
TowMech does not guarantee:
- That a provider will accept a request
- That service will arrive on time
- That a service will be completed successfully
- That a provider has specific skills/tools beyond their declared profile
- That prices will remain unchanged due to external conditions
Service availability depends on providers, location, demand, traffic, and technical limitations.
6. Platform Role: Independent Providers
All providers are independent third-party contractors and not employees, agents, or representatives of TowMech or Texas Computer Hub.
TowMech does not control:
- Provider behavior
- Provider equipment
- Provider decision-making
- Provider pricing outside Platform rules
- The quality or outcome of service
Any agreement for service is between the Customer and Provider.
7. Pricing, Fees & Payments
TowMech may charge:
- Booking fees
- Platform service fees
- Provider charges
- Processing fees
TowMech reserves the right to:
- Change fees at any time
- Apply penalties for cancellations, abuse, or misconduct
- Hold, delay, reverse, or suspend payments where fraud is suspected
All payments must follow the Platform’s approved payment method(s).
8. Cancellation Rules
TowMech may allow customers and/or providers to cancel jobs, but cancellation rules may vary by:
- Job status (created, assigned, in-progress, completed)
- Time elapsed
- Provider travel or arrival time
- Payment status
TowMech reserves the right to:
- Determine refund eligibility
- Reject refund requests
- Apply cancellation fees
- Limit repeated cancellations or abuse
TowMech decisions on cancellations and refunds are final.
9. Refund Policy
Refunds (if applicable) may depend on:
- Provider arrival status
- Service status
- Time window rules
- Verified disputes
TowMech is not obligated to issue refunds for:
- Customer errors in job details or location
- Provider delays due to traffic/weather
- Disputes that cannot be verified
- Suspicious behavior, fraud, or chargebacks
10. Prohibited Use
You may not use TowMech for:
- Fraud, scams, impersonation, or false requests
- Violence, harassment, threats, discrimination
- Theft or unlawful activities
- Uploading fake documents
- Damaging the Platform or disrupting services
- Attempting to bypass admin approval or verification rules
TowMech may report violations to authorities.
11. Provider Verification, Approval & Compliance
Providers may be required to submit documents such as:
- ID documents
- Licenses
- Vehicle proof
- Workshop proof
- Any additional documentation required by TowMech
TowMech may:
- Approve, reject, or request re-submission
- Temporarily hide provider features until approval is completed
- Suspend provider accounts if documents expire or appear invalid
Approval does not guarantee continued acceptance.
12. Communication & Monitoring
TowMech may monitor, record, or review:
- Messages
- Job logs
- Payment records
- Location data (while using the Platform)
- Account activity
This is for safety, dispute resolution, compliance, and system improvement.
13. Identity Disclosure & Legal Procedure
TowMech protects user identity and data.
However, TowMech may disclose user identity and information:
- When required by law
- When presented with valid legal process (court order, subpoena, police request)
- When necessary to protect TowMech, users, or public safety
- For fraud investigations and security enforcement
TowMech will only disclose identity through the proper procedure, and reserves the right to reject informal requests.
14. Limitation of Liability
To the maximum extent permitted by law:
TowMech, Texas Computer Hub, and its officers, employees, contractors, and partners will not be liable for:
- Injury, death, theft, robbery, loss, damage
- Property damage, vehicle damage, mechanical damage
- Disputes between customers and providers
- Delays, missed jobs, or service failure
- Lost profits, lost income, emotional distress
- Any indirect or consequential damages
Use of TowMech is at your own risk.
15. Indemnity
You agree to defend, indemnify, and hold harmless TowMech and Texas Computer Hub from any claims, losses, disputes, damages, legal fees, or liabilities arising from:
- Your use of the Platform
- Your violation of these Terms
- Your interaction with other users
- Your services (if you are a provider)
16. Service Interruptions & Changes
TowMech may:
- Update features
- Remove modules
- Disable services temporarily
- Shut down services in any region
- Perform maintenance without notice
TowMech is not responsible for downtime or losses resulting from service interruptions.
17. Intellectual Property
TowMech owns all rights to:
- App design, branding, logos
- Code, systems, UI, data structure
- Business processes and platform features
You may not copy, modify, reverse engineer, or resell TowMech.
18. Governing Law
These Terms are governed by the laws of: South Africa.
TowMech may choose the jurisdiction and venue for any disputes.
19. Updates to These Terms
TowMech may update these Terms at any time. Continued use after updates means you accept the new Terms.
